Legal
Terms of Use
Effective November 2, 2026
The short version
- Next Play is a directory. Any service, purchase, job, or agreement is between you and the business.
- We do not endorse, employ, or guarantee any business, and we are not a referral service or employment agency.
- Jobs and brand deals are applied for on the company's own site. Career tool suggestions are automated, so review them before use.
- Nothing here is medical, legal, financial, or compliance advice. Current athletes follow NCAA and school rules.
- Most disputes go to individual arbitration, with a 30-day opt-out. Texas law applies.
This summary is for convenience. The full text below controls.
These Terms of Use ("Terms") are a binding agreement between you and Next Play, Inc., a Texas corporation ("Next Play," "we," "us"). They cover makeyournextplay.com, the Next Play dashboards, the mobile apps, Next Play Live events, and every related service (together, the "Platform"). By creating an account, checking the box at sign-up, or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
Please read section 21 carefully. It requires most disputes to be resolved by individual arbitration and waives class actions.
1. Who can use Next Play
- You must be at least 17 years old. The Platform is not directed to anyone under 17, and we do not knowingly collect their information.
- If you are 17, you may use the Platform only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.
- You must give accurate information and keep it current. You may not create an account for someone else or impersonate anyone.
- If you sign up for a university or business, you confirm that you are authorized to bind that organization to these Terms.
2. Account types
The Platform offers accounts for current athletes, alumni athletes, individual athletes not connected to a partner school, university staff, businesses (providers, employers, and volunteer organizations), and Next Play staff. Features differ by account type. You are responsible for everything that happens under your account and for keeping your password secure. Tell us right away at info@makeyournextplay.com if you believe your account has been compromised.
3. What Next Play is, and what it is not
Next Play is an information platform. We provide career tools, a directory of businesses, links to job and volunteer opportunities, and communication tools between athletes and their universities.
Next Play is only a directory for businesses. When you find a provider, employer, or volunteer organization on the Platform, any contact, appointment, service, purchase, job application, employment, volunteer role, or other relationship is solely between you and that business. Specifically, Next Play:
- is not a party to any agreement, transaction, or relationship between you and a business;
- does not provide, supervise, direct, or control any business's services;
- does not employ, recommend, endorse, or guarantee any business listed on the Platform;
- is not a referral service, health care provider, law firm, financial advisor, real estate broker, or employment agency;
- does not collect payments for or on behalf of any business; and
- does not carry messages between athletes and businesses. You contact businesses directly, using the phone number, email, or website they list.
You are responsible for doing your own research before working with any business. That includes checking licenses, references, reviews, insurance, fees, and qualifications.
Your decisions are your own. Every decision you make with a business you find on the Platform is yours alone, and so are its results. That includes, for example:
- investing, saving, borrowing, or any financial product or strategy, and any gain or loss from it;
- buying, selling, renting, or leasing a home or other property, and any contract, price, inspection, or closing;
- buying insurance, choosing coverage, and any claim, denial, or gap in coverage;
- following a training program or exercise plan, and any injury that results;
- following a nutrition plan or taking supplements, and any health or eligibility effect;
- acting on legal, tax, accounting, or mental health advice; and
- accepting a job, volunteer role, offer, or discount.
Next Play does not review, approve, or take part in any of these decisions and is not responsible for them.
4. What the Verified check mark means
A Verified check mark means only that a business completed the review steps described in our Directory and Verification Policy at the time of review. It is not an endorsement, recommendation, warranty, or guarantee of the business's quality, safety, licensing status after the review date, conduct, or results. Many listings are unverified and were compiled from publicly available information; those listings have not been reviewed by Next Play. See the Directory and Verification Policy for details.
5. Directory information
Directory listings, including unverified listings, may be submitted by businesses or compiled by Next Play from public sources. We do not guarantee that any listing is accurate, complete, or current. Businesses can claim, correct, or ask us to remove their listing at any time.
6. Jobs and outside websites
- Job and volunteer listings come from employers who post on the Platform and from third-party job feeds. We do not write, review in full, or guarantee these listings.
- When you choose "Apply on company site," you leave the Platform. Your application, any interview, and any job offer are handled entirely by that employer under its own terms and privacy policy.
- Next Play does not make hiring decisions, guarantee interviews or jobs, or act as an employer or employment agency.
- Links to outside websites are provided for convenience. We are not responsible for their content, practices, or availability.
7. Career tools and generated content
The resume builder, athlete translator, cover letter writer, LinkedIn helper, interview practice, career path explorer, and similar tools may use automated systems, including artificial intelligence, to suggest content. Suggestions may be inaccurate or incomplete. You are responsible for reviewing, editing, and confirming everything before you use it, and for making sure your resume and applications are truthful. We do not guarantee that using any tool will lead to an interview, job, or other outcome.
8. Not professional advice; emergencies
Content on the Platform, including money basics, mental health resources, Life Playbook material, and event content, is general information only. It is not medical, mental health, legal, tax, financial, or career advice, and it does not create a professional relationship with Next Play. Consult a qualified professional about your situation.
If you are in crisis or thinking about harming yourself, call or text 988 (Suicide and Crisis Lifeline) in the U.S. In an emergency, call 911. The Platform is not monitored for emergencies.
9. NCAA, conference, and school rules
If you are a current student-athlete, you are solely responsible for following NCAA, conference, and school rules, including rules on name, image, and likeness (NIL), benefits, and employment. Some offers, discounts, or services from businesses may count as benefits under those rules. Check with your compliance office before accepting anything. If you post about a brand that pays you or gives you free products, you must clearly label the post as an ad (for example, "#ad" or "Paid partnership with Brand"), as the FTC's endorsement rules require. Next Play does not provide compliance advice.
10. Messaging and events
- Messaging on the Platform is between athletes and their connected university staff (either side can start a conversation), and between the Next Play team and athletes, universities, and businesses. Universities control their own messages and are responsible for them. Next Play may send you service messages, updates, and announcements in the Platform and by email; you can turn off marketing email at any time. Athletes and businesses do not message each other through the Platform.
- Universities create and run their own events. Next Play is not responsible for events hosted by universities or other organizations.
- If you attend a Next Play Live event or any in-person event, you do so voluntarily and at your own risk, and you agree to follow the event's rules. You may be photographed or recorded at Next Play events; see the event notice for details.
- We may review, limit, or remove messages or content that violate these Terms or that we are legally required to act on.
11. Your content
You keep ownership of what you upload or create, such as resumes, documents, volunteer logs, and messages ("Your Content"). You give Next Play a worldwide, non-exclusive, royalty-free license to host, store, copy, display, and process Your Content only to operate, improve, and secure the Platform and as described in the Privacy Policy. You confirm you have the rights to Your Content and that it does not violate any law or anyone's rights.
12. Rules of conduct
You agree not to:
- post false, misleading, harassing, threatening, discriminatory, sexually explicit, or unlawful content;
- impersonate a person, school, or business, or misrepresent your credentials;
- use the Platform to recruit athletes in violation of NCAA or school rules;
- scrape, copy, or harvest directory data or user information, or use it for spam or marketing lists;
- send unsolicited commercial messages through the Platform;
- upload malware or interfere with, probe, or overload the Platform;
- access accounts or data you are not authorized to access; or
- use the Platform in any way that violates law or these Terms.
13. Universities
University accounts are also governed by a separate written agreement between the university and Next Play. If that agreement conflicts with these Terms, the agreement controls for that university. A university that uploads a roster confirms it has the legal right to share that information with Next Play for the purposes in its agreement.
14. Businesses
Businesses that claim a listing or post on the Platform must also accept the Business Listing Agreement.
15. Fees
The Platform is currently free for athletes and for businesses. University partnerships are priced under a separate agreement. If we introduce fees for any service, we will tell you in advance, and you will not be charged unless you agree.
16. Next Play's property
The Platform, its design, software, text, graphics, logos, and the Next Play name are owned by Next Play or its licensors and protected by law. We give you a limited, revocable, non-transferable right to use the Platform for its intended purpose. You may not copy, modify, sell, or reverse engineer any part of it. If you send us feedback, we may use it without any obligation to you.
17. Copyright complaints
If you believe content on the Platform infringes your copyright, send a notice to our designated agent at info@makeyournextplay.com and 17304 Preston Rd Ste 800, Dallas, TX 75252 that includes the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512). We may remove content and terminate repeat infringers.
18. Disclaimers
THE PLATFORM, INCLUDING ALL DIRECTORY LISTINGS, VERIFICATION STATUSES, JOB LISTINGS, TOOLS, AND CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, NEXT PLAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. NEXT PLAY MAKES NO REPRESENTATION OR WARRANTY ABOUT ANY BUSINESS, PROVIDER, EMPLOYER, VOLUNTEER ORGANIZATION, UNIVERSITY, OR USER, OR ABOUT THE QUALITY, SAFETY, LEGALITY, OR OUTCOME OF ANY SERVICE, JOB, OR EVENT.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- NEXT PLAY AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND SPONSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, WAGES, OPPORTUNITIES, DATA, OR GOODWILL.
- NEXT PLAY IS NOT LIABLE FOR ANY ACT, OMISSION, ADVICE, SERVICE, PRODUCT, INVESTMENT, REAL ESTATE TRANSACTION, INSURANCE POLICY, TRAINING OR NUTRITION PROGRAM, JOB, PAYMENT, INJURY, LOSS, OR DAMAGE ARISING FROM YOUR DEALINGS WITH ANY BUSINESS, EMPLOYER, VOLUNTEER ORGANIZATION, UNIVERSITY, OR OTHER USER, WHETHER YOU FOUND THEM ON THE PLATFORM OR NOT.
- NEXT PLAY'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID NEXT PLAY IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow some of these limits, so they may not all apply to you.
20. Release and indemnity
Release. You release Next Play and its owners, officers, employees, agents, partners, and sponsors from all claims, demands, and damages of every kind, known and unknown, arising out of or connected with any dispute between you and a business, employer, volunteer organization, university, or other user. If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law in other states.
Indemnity. You agree to defend, indemnify, and hold harmless Next Play and its owners, officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your use of the Platform, Your Content, your dealings with any business or user, or your violation of these Terms or any law.
21. Disputes and arbitration
- Talk to us first. Before filing any claim, you agree to send a written description of the dispute to info@makeyournextplay.com and try to resolve it informally for 60 days.
- Binding individual arbitration. Any dispute that is not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator. The Federal Arbitration Act governs this section. The arbitration may take place by video or in Dallas County, Texas.
- Exceptions. Either party may bring an individual claim in small claims court, and either party may seek a court order to stop infringement of intellectual property.
- Class action waiver. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding.
- Opt out. You may opt out of this arbitration agreement by emailing info@makeyournextplay.com within 30 days after you first accept these Terms, with your name and a clear statement that you opt out.
- Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law.
22. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to section 21, any court proceeding will be brought only in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.
23. Suspension and termination
You may close your account at any time. We may suspend or end your access, or remove any listing or content, at any time if we believe you have violated these Terms, created risk for others or for Next Play, or if required by law. Sections 3 through 8 and 11 through 24 survive termination.
24. Changes and general terms
- We may update these Terms. If a change is material, we will notify you by email or on the Platform before it takes effect. Continuing to use the Platform after that means you accept the change.
- These Terms, the Privacy Policy, and any policy or agreement they reference are the entire agreement between you and Next Play about the Platform.
- If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver.
- You may not transfer these Terms. We may transfer them in connection with a merger, acquisition, or sale of assets.
- We are not liable for delays or failures caused by events beyond our reasonable control.
